Terms and Conditions of Bidding and Purchase – Online Tenders
Each unit listed on this website is currently located at the address indicated on the applicable online unit listing and each such unit is open for salvage bids. All bids are to be submitted by completing the appropriate web-based forms located on our website. Details, including but not limited to photographic images and text-based descriptions, regarding some of the items for sale have been provided on our website; while such details are thought by Manitoba Public Insurance to be accurate, there is NO GUARANTEE as to correctness of such details. It is the responsibility of the bidder to ensure that all such details are accurate. Manitoba Public Insurance will not be responsible for any errors in such details. All items are sold on an “as is, where is” basis.
WITHOUT LIMITATION, MANITOBA PUBLIC INSURANCE SPECIFICALLY DISCLAIMS ANY IMPLIED REPRESENTATION, WARRANTIES OF TITLE, MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND THOSE ARISING BY LAW OR THROUGH A COURSE OF DEALING OR USAGE OF TRADE, UNLESS SPECIFICALLY REQUIRED BY LAW. ALL SALES ARE FINAL.
As a buyer, you are obligated to complete the transaction with Manitoba Public Insurance if your bid is selected by Manitoba Public Insurance, unless the transaction is prohibited by law or by these terms and conditions. By bidding on an item you agree to be bound by the conditions of sale listed herein. Bids are not retractable, except in exceptional circumstances such as when Manitoba Public Insurance materially changes the item's description after you bid.
The successful bidder must remove all items from the applicable salvage yard:
Purchaser has 48 hours after the tender is closed.
Purchaser has seven days in which to pick up salvage.
Accel Towing Viewing/Pickup Hours (Monday to Friday 9:00 a.m. – 4:30 p.m.)
Submitted bid amounts MUST be the amount before taxes. Payment shall include Goods and Services Tax and Retail Sales Tax where applicable. Submitted bids must be accompanied by a valid Visa or Mastercard number, which shall be used to secure the submitted bid. Where the submitted bid is accepted by Manitoba Public Insurance, the submitted bid amount will be charged against the applicable submitted credit card number.
THE HIGHEST OR ANY BID WILL NOT NECESSARILY BE ACCEPTED.
By putting any item up for sale, Manitoba Public Insurance is not obligated to sell the item to any bidder.
Bidders are not to rely on any representation, whether oral or written, other than as expressed on Manitoba Public Insurance’s website. The information released on particular items on this website is only designed to reflect and summarize information concerning the said items, and is not necessarily a comprehensive description of such items. Except as required by law and only to the extent required, Manitoba Public Insurance will not be liable for any loss, damage, cost or expense arising from the statements or other representations, actual or implied, contained in or omitted from its website. Manitoba Public Insurance will not be liable for any reason as a result of the rejection or waiver of any bid.

Bidders are considered to have satisfied themselves as to the correctness and sufficiency of their bids including bid prices.
Each bidder acknowledges that neither the bidder nor any of its officers, employees or agents has attempted to or will attempt to improperly influence an officer of Manitoba Public Insurance in connection with the assessment of the bids.
Each bidder warrants that:
(a) it has the necessary power to submit a bid; and
(b) it is not a party to, or bound by or subject to any agreement, instrument, indenture, charter or by-law provision, statute, regulation, order, judgment or law which would be violated, contravened or breached by, or under which any default would occur as a result of submitting its bid(s).
The Tender and sale of items shall be subject to the laws of the Province of Manitoba.
Bidders acknowledge that where a vehicle is listed as “Irreparable”, “Salvageable” or “Writeoff”, that such vehicle is mechanically and otherwise unfit to be driven on the highways of Manitoba in accordance with Section 204(1) of The Highway Traffic Act. Bidders further acknowledge that vehicles designated as “Salvageable” and “Writeoff” will require the appropriate certification, which may include a Certificate of Inspection or Body Integrity Certificate, prior to registration in Manitoba. It is further acknowledged that vehicles designated as “irreparable” cannot be re-registered or insured in Manitoba.
By supplying information to Manitoba Public Insurance you consent to the use of such information for the limited purposes of administering the Tender(s) for which you have submitted a bid.
Information you submit to Manitoba Public Insurance is secure. We always use industry-standard encryption technologies when transferring and receiving consumer data exchanged with our site. We have appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of information that we have collected from you at our site.
