Bodily Injury/PIPP Claims > Criminal Code Convictions

In general, the Personal Injury Protection Plan (PIPP) covers injuries from a vehicle collision, no matter who caused the collision or how it happened. However, for persons who are convicted of certain Criminal Code offences related to the collision, income replacement will be reduced for the first 12 months following the collision. Compensation for permanent impairments and fatality payments are also reduced.

These reductions correspond to the degree the person is responsible for the collision. The reductions for income replacement and fatality payments are also based on the number of dependants.

If a person is convicted in the United States for a crime related to the collision, it will have the same impacts as if the offence occurred in Canada.

No income replacement will be paid to a person while they are in prison or in jail because of a conviction imposed for any offence.

As of June 16, 2011, if you’re convicted of any of the following crimes related to the collision, PIPP benefits will not be paid. If you were paid any benefits under PIPP before you were convicted, you must pay them back.
