CONTEST DESCRIPTION

Driver Ed Challenge (the "Contest") is a knowledge and driving skills contest held within the current 2009/2010 school year. The Contest is open to current and recent students of the High School Driver Education Program offered in the majority of Manitoba high schools to encourage and reinforce safe driving behavior, attitudes and actions on the road. Finalists are determined by a successful progression through three challenges: Challenge 1 - Knowledge Challenge (Sept. 28/09 – February 8/10); Challenge 2 - Driving Challenge (February 9/10 - April 30/10); and Challenge 3 - Skills Competition (May 29/10). Scholarships for $1,500, $1,000 and $500 will be awarded to first, second and third-place contestants, respectively, to be used towards educational tuition at a post-secondary education institution. Prize merchandise will be awarded randomly to top scorers in each phase.


HOW TO ENTER:


To be eligible to advance to the Driving Challenge of the Contest, a contestant must correctly answer each of twenty questions posed to them in the Knowledge Challenge available at http://www.mpi.mb.ca/ The Knowledge Challenge phase opens September 28, 2009 and closes February 8, 2010 (the "Entry Period"). Only completed Online Quiz entries received during the Entry Period and containing valid contact information will be eligible to be selected for participation in the Driving Challenge phase of the Driver Ed Challenge. All entries shall become the property of the Manitoba Public Insurance.

All contestants who have correctly answered all twenty questions in the Knowledge Challenge to the satisfaction of Manitoba Public Insurance shall be placed in a series of random draws to determine the participants of Challenge 2 of the Contest. The Challenge 1 contestants shall be separated by region, with each region having its own draws, in order to ensure representation from all of Manitoba’s regions in the Driving Challenge phase of the contest to take place February 9, 2010 to April 30, 2010. The Regions shall consist of the Winnipeg region, the Northern Manitoba region, the Southern Manitoba region, the Eastern Manitoba region and the Western Manitoba region. The first 120 qualified entries chosen, as determined by Manitoba Public Insurance in its sole discretion, shall be eligible to participate in the Driving Challenge phase. Where a vacancy occurs as a result of a chosen contestant declining or otherwise being unable to participate in the Driving Challenge phase, Manitoba Public Insurance reserves the right to randomly select another contestant to take the place of the unavailable contestant. As a condition of participating in the Driving Challenge phase, chosen contestants shall be required to execute a waiver in form and content satisfactory to Manitoba Public Insurance, and shall be required to abide by and unconditionally accept the rules and judging criteria relating to the Driving Challenge, such rules and judging criteria to be announced or confirmed prior to the commencement of the Driving Challenge. The most successful contestants in the Driving Challenge, as judged by Manitoba Public Insurance, shall move on to the SKills Competition, which shall be held in Winnipeg on May 29, 2010. Travel to the Skills Competition phase shall be the responsibility of the contestant.

Although online access is required in order to participate in this Contest, no purchase of any kind is required. Many public libraries, schools, museums, retail businesses and others offer free access to internet connected computers.


ADMINISTRATION:


This Contest is administered by Manitoba Public Insurance. All decisions of Manitoba Public Insurance are final and binding in all matters as they relate to this Contest.


ELIGIBILITY:

To be eligible to enter the Contest, a contestant must be:
• a resident of Manitoba;
• aged 15 years, six months or older by September 28, 20
09;
• in possession of a valid Manitoba Driver’s Licence or Learner’s Permit at the time their Online Quiz entry was received by Manitoba Public Insurance;
• attending high school on a full time basis in the year the 2009-2010 school year;
• a current Driver’s Education student or a past Driver’s Education student with a learner or intermediate licence;
• free of any at fault accidents; and
• free of any convictions for offenses under The Highway Traffic Act.

As a condition of advancing to the Driving Challenge and/or the Skills Competition, all chosen Contestants shall allow Manitoba Public Insurance to view a current driver’s abstract, and to allow Manitoba Public Insurance to review a current driver’s abstract annually for a period of three years following the Contestant’s selection to participate in the Driving Challenge. The sole purposes for collecting and using this information shall be for:
(a) verifying eligibility requirements; and
(b) assessing the impact of participation in the Contest on driving habits and driving records of various Contestants.

The Contest is not open to employees and representatives of Manitoba Public Insurance and members of the immediate families of such employees or representatives and persons with whom such employees and representatives are domiciled. For the purpose of this Contest, "immediate family" is defined as parent, sibling, child or any person residing in the same household as, or domiciled with, any such employees or representatives. The Contest is not open to any person who participated as a contestant in the Skills Competition portion of the contest in any previous year.


PRIZES:

Challenge 1
Those contestants who get all twenty questions right in the Knowledge Challenge shall be put into a random draw to win one of four Ipod Nano MP3 players, or one of ten Manitoba Public Insurance merchandise packs. One MP3 player draw and two Manitoba Public Insurance merchandise pack draws shall take place monthly, commencing in October and ending in February.

Challenge 2
The contestant who Manitoba Public Insurance deems to have the best score in the Driving Challenge shall win a laptop computer. Where two or more contestants finish tied with the best score in Challenge 2, Manitoba Public Insurance shall conduct a random draw amongst those contestants that are tied for the best score in order to determine the winner of the laptop computer. The contestants who Manitoba Public Insurance deems to have the second best, third best, and fourth best scores in Challenge 2 shall each win an Ipod Nano MP3 player. Where two or more contestants finish tied with the fourth best score in Challenge 2, Manitoba Public Insurance shall conduct a random draw amongst those contestants that are tied in order to determine the winner of the Ipod Nano MP3 player.

Challenge 3
The first place contestant in the Skills Competition phase, as determined by Manitoba Public Insurance, shall receive a $1,500 scholarship and a trophy.

The second place contestant in the Skills Competition Challenge, as determined by Manitoba Public Insurance, shall receive a 1,000 scholarship and a trophy.

The third place contestant in the Skills Competition Challenge, as determined by Manitoba Public Insurance, shall receive a $500 scholarship and a trophy.

Scholarships shall be paid by Manitoba Public Insurance directly to the winners, upon the winners providing Manitoba Public Insurance with confirmation of registration to a post secondary educational institution.

In addition, all contestants who qualify for the Challenge 3 portion of the contest shall receive a t-shirt, and selected teams in the competition shall be eligible to receive merchandise prize packs.

Before being awarded a prize, a winner may also be required to sign a declaration and release form stating that he/she has read, understood and complied with these Contest Rules, grants all consents required as contemplated in these Contest Rules, and releases Manitoba Public Insurance from any and all liability of any kind arising out of the selected contestant's participation in this Contest and receipt and use of the prize. The odds of winning a prize depends on the number of eligible entries received.

GENERAL CONDITIONS:

Manitoba Public Insurance extends absolutely no representations or warranties in respect of any prizes and accepts no liability arising in respect of such prizes. Prizes must be accepted as awarded with no substitutions, provided that Manitoba Public Insurance shall have the right, at its sole discretion and for any reason, to substitute a prize or prizes of equal or greater monetary value.

If for any reason, in the opinion of Manitoba Public Insurance, in its sole discretion, the Contest is not capable of running as planned or if the administration, security, fairness, integrity, or proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond its control, Manitoba Public Insurance reserves the right to cancel, terminate, modify or suspend the Contest.

Manitoba Public Insurance will not be responsible for telephone, technical, network, online, electronic, computer hardware or software failures of any kind, misdirected, stolen, incomplete, garbled or delayed Internet/e-mail computer transmissions on account of technical problems or traffic congestion on the Internet or at any Web site or otherwise, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation or downloading any materials in this Contest.

Manitoba Public Insurance reserves the right, in its sole discretion, to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Contest Rules or otherwise in a disruptive manner. Manitoba Public Insurance reserves the right to modify the Contest Rules without materially affecting the terms and conditions of the Contest.

By entering the Contest, each Contestant agrees to release and hold Manitoba Public Insurance and the employees, officers, directors, agents, representatives of Manitoba Public Insurance harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

Subject to all applicable Canadian federal, provincial and municipal laws and regulations, these Contest Rules govern all aspects of the Contest and are binding on all participants.

By entering the Contest, all contestants acknowledge these rules and agree to abide by them.

PRIVACY POLICY:

By supplying information to Manitoba Public Insurance throughout the Course of the Contest, all Contestants consent to the use of such information to administer, implement and fulfill this Contest.
